The EU's labelling duty for AI-generated content has applied since Sunday, and the companies covered are still unclear how to apply it. Brussels' enforcement team is meanwhile weighing whether ChatGPT and Roblox fall under its strictest platform tier.

The European Union applies graduated obligations to online platforms, with the heaviest duties reserved for the largest services. Bloomberg reports that the European Commission intends to pull the chatbot ChatGPT and the gaming platform Roblox into that strictest category, extending rules written for social networks and marketplaces to AI and gaming services. Pressure is also coming from national governments: France's high commissioner for children, Sarah El Haïry, has referred the AI model repository Hugging Face to the Commission. Her referral follows findings by the NGO AI Forensics that seven of the nine image-editing models most prominently featured on Hugging Face let users strip clothes off people with simple prompts. Together the two moves test how far the bloc's platform rulebook reaches into AI tools and who is accountable for what those tools produce.
